I am looking to determine how I can apply for guardianship of my younger sister. The Department of Mental Retardation has assigned an attorney as her guardian. He lives an hour from her and has never even met her. Close to one year later, he has still not met her, but is proceeding to advocate and make decisions for her. She is very depressed and receiving atrocious care at the residential home she's in and I feel like there is nothing I can do. I am an established business owner and responsible adult, so I am not certain why I was not even considered. My sister and I have been extremely close all of our lives and DMR overlooks anything I have to say. If you have any suggestions, please let me know.

We seem to have a similar problem whereby DMR usurps guardianships from parents in order to exercise total control without accountability. This may also happen when DMR goes to bat in court for one of its vendors, with which a parent or relative may have a problem -- regardless of the merits of the situation.

I have introduced legislation which would help to address this problem by making it statute law in Masschusetts that the parent of a disabled person must be the preferred guardian -- barring competent evidcne to the contrary. (The inference is that a relative would also be accorded the same rights.)

The bill I have submitted is H. 1578. For the text, my testimony before the Judiciary Committee, and a letter of support can be accessed at www.cofar.org.

If you would care to support this, please let me know. I am well aware that COFAR and Mass Arc are at odds over proposed closings of the state schools, but this is an issue upon which both organizations can and should agree. Indeed, Mass Arc supported it when I first introduced it -- ten years ago.
